A MAN accused of raping a woman in Gympie's main street earlier this month was granted bail on Monday despite police objections.

The 42-year-old Mary Valley man, who cannot yet be named for legal reasons, appeared in Gympie Magistrates Court from the prisoner's dock this morning, fidgeting as Magistrate G. Hillan read the police prosecutor's objection to bail.

The man had been held in custody since Thursday afternoon, when he handed himself in to the Gympie Police Station after police released an image captured on CCTV.

He has not yet pleaded guilty or not guilty to one charge of rape.

Duty lawyer Rachel Tierney said since the man had handed himself in to police, the court could trust him to front up for his next appearance.

"He's not shying away from the allegations before the court," Ms Tierney said.

She said he had no criminal history of violence or sex offences, and was currently seeking employment in the Gympie area.

The prosecutor objected to the bail, telling the court the man had made "numerous" breaches of community-based court orders in the past, and so was unlikely to comply with bail conditions.

She said there was an "unacceptable risk" he could commit an offence, fail to appear for his next court date or otherwise breach bail.

The man's partner supported him from the courtroom gallery, and put her face in her hands in apparent relief as Mr Hillan granted bail.

The magistrate described the charge as "quite serious", and imposed bail conditions that the accused live at the agreed Mary Valley address, abide by a curfew between 7pm and 6am, not drink alcohol or contact the alleged victim, and report twice a week to the Gympie Police Station.

The case will be back in Gympie Magistrates Court on November 14.
